NRO case: SC’s July 12 judgment unlawful, says AGP . |
|
ISLAMABAD: The Attorney General Pakistan (AGP), Irfan Qadir Wednesday filed a review petition for Supreme Court’s July 12 verdict suggesting that writing a letter to Swiss authorities was against the constitution. The petition was filed after the Supreme Court issued a show cause notice to Prime Minister Raja Pervez Ashraf for his failure to implement SC’s order and writing to Swiss authorities to open graft cases against President Zardari. The review petition filed by the AGP states that the seven member bench of the apex court summoned a democratically elected prime minister (Yousaf Raza Gilani) three times which made a mockery of the constitution. The petition furthers that court’s decision in NRO implementation case was unacceptable, adding that the court did not hear the 8,000 individuals whose cases were resurrected after NRO was declared unconstitutional. The AGP in his petition to the apex court stated that declaring NRO unconstitutional was ‘a one of its kind decision on the face of the earth,’ adding that court June 27 and July 12 judgment were unlawful and in violation of Article 248 of the Constitution.
SC July 12 decision
Supreme Court in its July 12 decision noted, “Adjourned to July 25 on which date the Prime Minister of Pakistan/Chief Executive of the Federation shall cause a report to be submitted before this court regarding compliance of the directions contained in paragraph No. 177 and 178 (writing the letter to Swiss authorities) of the judgment passed by this court in case of Dr Mobashir Hassan (NRO case) failing which this court may initiate any appropriate action under the Constitution.”
